1. Overview#

These Terms of Use ("Terms") govern your access to and use of the Forestall website, pages, and online materials (collectively, the "Site"). By accessing or using the Site, you agree to these Terms.

If you are a Forestall customer using our products or platform through a separate written agreement (e.g., a Master Service Agreement, subscription agreement, order form, DPA), that agreement governs your use of the product or platform services ("Customer Agreement"). These Terms primarily apply to the Site and public-facing content.

2. Agreement to Terms#

By using the Site, you confirm that you:

• Have read and understood these Terms, and
• Agree to be bound by them.

If you do not agree, do not use the Site.

3. Who We Are#

"Forestall," "we," "us," and "our" refers to Forestall and its affiliates that operate the Site.

4. Eligibility#

You must be legally able to enter into a binding agreement to use the Site. The Site is intended for business use. If you use the Site on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

5. Changes to Terms#

We may update these Terms from time to time. We will update the "Last updated" date when changes are made. Your continued use of the Site after changes become effective means you accept the updated Terms.

6. Website Use and Acceptable Use#

You agree to use the Site only for lawful purposes and in accordance with these Terms.

You must not:

• Use the Site in a way that violates applicable laws or regulations
• Attempt to gain unauthorized access to any systems, accounts, or data
• Interfere with or disrupt the Site (including via excessive requests, scanning, or automated scraping)

8. Intellectual Property#

The Site and its content (including text, designs, graphics, logos, UI elements, and downloadable materials) are owned by Forestall or its licensors and are protected by intellectual property laws.

You may:

• View and use the Site for your internal business purposes, and
• Download materials only if explicitly made available for download and only for internal evaluation.

You may not:

• Copy, reproduce, distribute, publicly display, or create derivative works from the Site content without our written permission (except as allowed by law)
• Use our trademarks, logos, or brand elements without written approval

9. User Content and Feedback#

If the Site allows you to submit content (e.g., contact forms, event registrations, support messages), you grant us a limited license to use it to respond to you, operate the Site, and improve our services.

To the maximum extent permitted by law, Forestall and its affiliates, officers, employees, agents, and licensors will not be liable for:

• Indirect, incidental, consequential, special, or punitive damages
• Loss of profits, revenue, business opportunities, data, or goodwill
• Damages arising from your use of (or inability to use) the Site or reliance on Site content

If liability cannot be excluded, it will be limited to the minimum amount permitted by law.

13. Indemnification#

To the extent permitted by law, you agree to indemnify and hold harmless Forestall from claims arising out of:

• Your misuse of the Site
• Your violation of these Terms
• Your infringement of any rights of another party through your submissions or actions

14. Suspension and Termination#

We may suspend or terminate your access to the Site at any time if:

• We reasonably believe you violated these Terms
• It is necessary to protect the Site, users, or Forestall
• We are required to do so by law

Sections that by their nature should survive termination will survive (e.g., IP, disclaimers, limitation of liability, indemnification).

15. Governing Law and Disputes#

These Terms are governed by the laws of the Republic of Türkiye. Courts located in Ankara, Türkiye will have jurisdiction, unless otherwise required by applicable law.
